By accessing or using the website at sanbernardinomasonry.com, requesting a quote, or entering into any service agreement with SBD San Bernardino Masonry, you agree to these terms and conditions in full. If you do not agree, please do not use our website or request our services. These terms apply to all visitors, customers, and others who interact with us.
SBD San Bernardino Masonry is a masonry contractor based in San Bernardino, CA. We provide residential and commercial masonry services including, but not limited to, foundation repair, chimney repair, brick repair, tuckpointing, retaining wall construction, driveway pavers, fireplace installation, stone work, and related masonry services. All work is performed by our crew or under our direct supervision.
We reserve the right to decline any service request at our discretion. Acceptance of a project is confirmed only upon written agreement or signed proposal.
All estimates are based on the information available at the time of inspection. An estimate is not a guaranteed final price. Final pricing may change if conditions discovered during work differ from what was visible during the initial assessment - for example, if hidden damage is uncovered once work begins.
We will communicate any changes to scope or cost before performing additional work. Verbal estimates are approximations only. Written, signed proposals are the binding agreement for project scope and pricing. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
Project start dates are scheduled based on crew availability and permit timelines. We will provide reasonable advance notice of the scheduled start date. Weather conditions, permit delays, or circumstances outside our control may affect scheduling. We are not liable for delays caused by these factors.
If you need to cancel or reschedule a confirmed project, please notify us as soon as possible and no later than 48 hours before the scheduled start date. Cancellations made with less than 48 hours notice may result in a cancellation fee to cover mobilization costs already incurred. Any deposits paid for materials that have been ordered or fabricated are non-refundable.
Payment terms are outlined in each written proposal. A deposit may be required before work begins, particularly for larger projects or projects requiring custom materials. The remaining balance is due upon completion of work unless otherwise agreed in writing.
Accepted payment methods will be specified on your proposal. Late payments may be subject to interest charges as permitted by California law. If payment is not received within 30 days of the invoice date, we reserve the right to pursue collection through available legal remedies.
We stand behind our workmanship. Any warranty on labor is specified in your written project agreement. Materials are subject to the manufacturer warranties, which we will communicate where applicable.
Warranties do not cover damage resulting from conditions beyond the scope of the completed work, including but not limited to: soil movement not addressed in the original project, water damage from sources unrelated to our work, seismic events, or modifications made to completed work by others.
Our website content, including service descriptions and general information, is provided for informational purposes only. We make no representations or warranties about the completeness or accuracy of website content as it applies to your specific property or circumstances. Always request an in-person inspection for project-specific assessments.
You agree to provide accurate information about the property and the work requested. You are responsible for ensuring we have lawful access to the work site on scheduled days. If access is blocked or conditions are unsafe, we reserve the right to reschedule at your expense.
You are responsible for notifying us of any underground utilities, HOA restrictions, or property-specific conditions that may affect the project before work begins. SBD San Bernardino Masonry is not liable for damage resulting from undisclosed site conditions.
To the fullest extent permitted by law, SBD San Bernardino Masonry shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to our services or your use of our website.
Our total liability to you for any claim arising from services provided shall not exceed the amount you paid us for the specific project giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought.
If a dispute arises between you and SBD San Bernardino Masonry, both parties agree to first attempt to resolve the matter through direct communication. Either party may request a written description of the issue and a proposed resolution.
If direct resolution is unsuccessful, both parties agree to attempt mediation before pursuing litigation. Mediation shall take place in San Bernardino, CA, using a mutually agreed-upon mediator. If mediation fails, disputes shall be resolved through binding arbitration or litigation in the courts of CA, as appropriate.
These terms and conditions are governed by the laws of the State of CA, without regard to its conflict of law provisions. Any legal proceedings arising under these terms shall be brought in the appropriate courts of San Bernardino County, CA.
We reserve the right to update these terms and conditions at any time. When we make changes, we will update the effective date at the top of this page. Your continued use of our website or services after any changes constitutes your acceptance of the updated terms. We recommend reviewing this page periodically.
